If you have been charged with a gun crime under the NY SAFE Act, enlist an experienced lawyer. The Law Office of Kelley M. Enderley, PC can help. We understand the complexities of this new legislation. We have the knowledge and experience to provide you the criminal defense representation you need.

What Is The NY SAFE Act?

In the aftermath of the Sandy Hook Elementary School shooting in Connecticut, New York passed the New York Secure Ammunition and Firearms Enforcement Act of 2013, more commonly known as the NY SAFE Act. This is a gun control law designed, in theory, to prevent dangerous weapons from falling into the hands of people who would use them to cause harm.

Who The NY SAFE Act Really Targets

While the intention behind this new law is good, the unfortunate reality is that it really targets many people who have the legal right to possess and carry firearms. For example, one of the provisions of the NY SAFE Act is that a person can have no more than seven rounds in the magazine of his or her gun at any time. If that person is pulled over for a traffic violation and found with eight or more bullets in a weapon, even if that person has a permit for the gun and everything else is perfectly legal, that person may be charged with a firearm violation.

In addition to possible criminal charges, a person who is found to be in violation of the NY SAFE Act may have his or her weapons confiscated. This can be a very costly loss. Furthermore, that person's permit may be revoked.

Our NY SAFE Act attorney stands up for the rights of people charged with gun crimes. We will fight the criminal charges, strive to have forfeited weapons returned and represent you in court to prevent your permit from being taken away. If your permit is revoked, we may be able to assist in finding a way for you to apply for it again or have it reinstated. The constitution provides the right to own weapons, and we are here to protect your right.
