Eliot Spitzer, Silda Wall end marriage with uncontested divorce

Former New York Gov. Eliot Spitzer and his wife, Silda Wall, have filed divorce papers. The two reportedly settled all of their divorce matters outside of court in the uncontested divorce. The couple, who had been married for 26 years, announced that they were breaking up in December.

In most cases, uncontested divorces are more beneficial for individuals than contested divorces. Uncontested divorces allow married couples to negotiate the terms of divorce - property division, child custody, spousal support and more - outside of court in order to reach amicable resolutions.

Those who opt for uncontested divorces in New York are typically able to avoid the costs associated with litigation. They are also able to make their own decisions about their divorce settlements rather than leave matters up to a judge.

In cases involving high-profile couples, choosing to divorce amicably helps to keep the details of the divorce out of the public eye.

Little has been reported about the Spitzer and Wall divorce, other than the fact that it has been filed. The details of the property division settlement are likely going to be kept confidential, and this may not have been the case had the two gone to court to dispute the division of marital assets.

The couple was tasked with dividing a complex marital estate upon breaking up. Spitzer's net worth has been estimated to be around $50 million, and Wall herself is an executive with an equity firm. Spitzer's family also has a $1 billion real estate empire by some estimates.

While uncontested divorces are preferred by many New York residents, in some cases it is necessary to enter into litigation in order to protect one's rights and interests. It is important that individuals talk to their family law attorneys about how to best handle the divorce process in their unique circumstances.
