Appearing by Affidavit

When an individual is not available to go to Court but an attorney is retained for certain proceedings an individual can sign an authorization to allow the attorney to appear for them in Court. This is generally the standard proceeding for most vehicle and traffic violations such as speeding tickets.

Occasionally this occurs on misdemeanor matters as well when an individual is not able to attend court due to being away at college, residing out of state or if they are incapacitated in some manner that does not permit them to come to court. It is important to always keep in touch with your attorney.

However, while this option may be available to an individual it should not always be utilized. Speak to your attorney as to whether or not this is an option that applies to you if you have difficulty attending court.
